Rules on Home Information Packs re-honed

 

On 21 May 2010 Statutory Instruments came into force with immediate effect. 

 

The requirement for sellers to provide Home Information Packs when marketing residential properties has been suspended.

 

Energy Performance Certificates must still be obtained.  However, the seller of a residential property need only commission this before marketing and they are now valid for 10 years.

Valuers may not be negligent even if method incompetent

The recent decision of K/S Lincoln and others v CB Richard Ellis Hotels Limited [2010] EWHC 1156 (TCC) confirms that a valuer will not necessarily be found to have been negligent if the valuer values the property within a permissible 10% margin of error even if the valuer fell below the standard of a reasonable valuer in his methodology in reaching the valuation.
